Terms & Conditions

These Terms & Conditions apply to yacht charter bookings made with BLUE FREEDOM YACHTING N.E.P.A., a Greek maritime company registered at Kyprou 7, 85300 Kos, Greece, VAT number EL996644341.

By making a booking, paying a deposit, or using our services, the customer agrees to these Terms & Conditions.

2. Booking Confirmation

A booking is only confirmed once the required deposit, first payment, or full payment has been received by Blue Freedom Yachting.

The booking confirmation will specify the yacht, charter period, embarkation port, disembarkation port, embarkation time, disembarkation time, number of guests, itinerary or cruising area, charter fee, and any included or excluded services.

Blue Freedom Yachting reserves the right to refuse or cancel a booking if payment is not received on time or if the customer provides incomplete or inaccurate information.

3. Payment Terms

Unless otherwise agreed in writing, the payment schedule will be stated in the booking confirmation.

The remaining balance, if applicable, must be paid no later than 20 days before embarkation, unless a different payment deadline has been agreed in writing.

If any payment is not made by the due date, Blue Freedom Yachting may cancel the booking and retain any amounts due according to the cancellation policy.

4. Charter Fee and Excluded Costs

The charter fee includes only the services expressly stated in the booking confirmation.

Unless expressly included in writing, the charter fee does not include fuel, food, drinks, private marina fees, port fees, customs fees, transit fees, taxes, transfers, special requests, personal expenses, or any other extra services.

Any additional services requested by the customer may be charged separately.

5. Embarkation and Disembarkation

The customer must arrive at the agreed embarkation port at the agreed embarkation time.

The yacht must be returned to the agreed disembarkation port at the agreed disembarkation time.

If the customer arrives late, no refund or extension is guaranteed. Any extension is subject to availability and approval by Blue Freedom Yachting and the captain.

6. Yacht Delivery

Blue Freedom Yachting will deliver the yacht to the customer at the agreed embarkation port in good working order, seaworthy, clean, equipped, and ready for service.

The customer accepts the yacht upon embarkation unless any issue is immediately reported to the captain.

7. Delay in Yacht Delivery

If delivery of the yacht is delayed due to force majeure and the yacht is delivered within 24 hours of the scheduled start time or within one seventh of the charter period, whichever is shorter, the customer may receive a pro-rata refund for the lost charter time or, if mutually agreed, a pro-rata extension of the charter period.

Blue Freedom Yachting is not responsible for additional travel, accommodation, or personal expenses caused by a delay.

8. Customer Responsibilities

The customer is responsible for themselves and all guests included in the booking.

The customer agrees to ensure that all guests comply with these Terms & Conditions, the captain’s instructions, safety rules, and all applicable laws and regulations.

The customer is responsible for any damage to the yacht, equipment, furnishings, or property caused by the customer or their guests, except for fair wear and tear arising from ordinary use.

9. Guest Limits

The number of guests must not exceed the maximum number stated in the booking confirmation or the yacht’s permitted capacity.

Additional guests are not allowed without prior written approval from Blue Freedom Yachting. Extra guests may be subject to additional charges.

Blue Freedom Yachting and the captain reserve the right to refuse boarding to any person exceeding the agreed guest limit.

10. Children

Children are allowed only where agreed as part of the booking.

The customer, parents, or guardians are fully responsible for the supervision, safety, conduct, and entertainment of children on board.

Crew members are not responsible for supervising children.

11. Health, Fitness, Visas, and Travel Documents

The customer confirms that they and all guests are medically fit to participate in the charter.

The customer must inform Blue Freedom Yachting in advance of any health condition, disability, mobility limitation, allergy, medical treatment, or special requirement that may affect the charter.

The customer and guests are responsible for having valid passports, visas, permits, and any other travel documents required for the countries, waters, or ports visited.

Blue Freedom Yachting is not responsible if the customer or any guest is unable to board or continue the charter due to missing, invalid, or insufficient travel documents.

12. Captain’s Authority

The captain has full authority over the operation, navigation, safety, itinerary, movement, and management of the yacht.

The customer and guests must follow the captain’s instructions at all times.

The captain may refuse any request or instruction that, in the captain’s reasonable opinion, may endanger the yacht, guests, crew, environment, or property, or may breach applicable laws, regulations, safety requirements, or these Terms & Conditions.

The captain may change the route, itinerary, stops, anchoring locations, or schedule due to weather, sea conditions, safety concerns, technical issues, port restrictions, legal requirements, or operational reasons.

If the customer or guests fail to follow the captain’s instructions or breach these Terms & Conditions after warning, Blue Freedom Yachting may terminate the charter without refund.

13. Cruising Area and Itinerary

The yacht may only cruise within the agreed cruising area and within waters where the yacht is legally permitted to operate.

Any itinerary, route, destination, or stop is subject to weather, sea conditions, safety, port permissions, legal restrictions, and captain approval.

Itineraries are indicative and may be changed where necessary for safety, legal, operational, or weather-related reasons.

14. Weather and Sea Conditions

Weather and sea conditions may affect the charter, route, itinerary, comfort, timing, or ability to visit certain destinations.

No refund is provided for cancellation, delay, route change, itinerary change, missed destination, or inconvenience caused by weather or sea conditions.

The captain has final authority to decide whether sailing, anchoring, swimming, water activities, or specific routes are safe.

Where possible, Blue Freedom Yachting may offer an alternative itinerary or rescheduling option, but this is subject to availability and is not guaranteed.

15. Fuel, Food, Drinks, Port Fees, Marina Fees, and Taxes

Unless expressly included in the booking confirmation, fuel is not included in the charter fee and may be charged separately.

Food, drinks, full board, special menus, alcoholic beverages, marina fees, port fees, customs fees, local taxes, transfers, and personal expenses are not included unless expressly stated in writing.

Private marina stops or special route requests may result in additional charges.

The customer is responsible for any extra costs arising from itinerary changes requested by the customer, subject to captain and company approval.

16. Insurance and Liability

The yacht is insured according to applicable maritime requirements.

Customers and guests participate in swimming, snorkeling, water sports, tender use, and use of any sports equipment at their own risk.

Blue Freedom Yachting is not responsible for injury, accident, illness, loss, or death resulting from swimming, snorkeling, water sports, alcohol consumption, unsafe behavior, failure to follow instructions, or personal negligence.

Customers are strongly advised to obtain suitable travel insurance, medical insurance, cancellation insurance, and personal liability insurance before the charter.

17. Prohibited Items and Conduct

Illegal drugs, weapons, firearms, explosives, hazardous materials, and unlawful activity are strictly prohibited on board.

Pets or animals are not allowed on board without prior written approval from Blue Freedom Yachting.

The customer and guests must not behave in a way that causes danger, nuisance, damage, disturbance, reputational harm, or legal risk to the yacht, company, captain, crew, other guests, third parties, ports, marinas, or authorities.

Abusive, aggressive, unsafe, intoxicated, or unlawful behavior may result in immediate termination of the charter without refund.

If the customer or guests commit an offence or breach any law or regulation resulting in fines, detention, seizure, arrest, penalties, delays, losses, or legal action, the customer shall be responsible for all resulting costs, losses, damages, and expenses.

18. Damage to Yacht or Equipment

The customer is responsible for any damage, loss, breakage, or excessive cleaning caused by the customer or guests.

This includes damage to the yacht, equipment, furnishings, tenders, water toys, safety equipment, interiors, decks, electronics, linens, and other property.

Blue Freedom Yachting may charge the customer for repair, replacement, cleaning, recovery, or related costs.

19. Early Return by Customer

If the customer chooses to end the charter early, return to port early, disembark early, or not use part of the charter period, no refund will be due for unused time.

20. Late Return by Customer

If the customer causes a delay in returning the yacht to the agreed disembarkation port at the agreed disembarkation time, the customer may be charged pro-rata additional charter fees and any losses, expenses, or damages caused by the delay.

This does not apply where the delay is caused by force majeure or by a decision of the captain for safety reasons.

21. Breakdown or Disablement

If, after delivery, the yacht suffers a mechanical breakdown, disablement, fire, collision, grounding, or similar event that prevents use of the yacht for 48 consecutive hours or more, and the issue was not caused by the customer or guests, the customer may terminate the charter and receive a pro-rata refund for the unused charter time from the time of loss of use.

Blue Freedom Yachting may, where possible, offer an alternative yacht or alternative arrangement, but this is subject to availability.

Blue Freedom Yachting is not liable for additional travel, accommodation, emotional distress, loss of enjoyment, indirect damages, or consequential losses.

22. Customer Cancellation

If the customer cancels the booking, the following cancellation fees apply unless otherwise agreed in writing:

  • 120 days or more before embarkation: 30% of the charter fee is retained.
  • 119 to 91 days before embarkation: 50% of the charter fee is retained.
  • 90 to 32 days before embarkation: 75% of the charter fee is retained.
  • 31 days or less before embarkation: 100% of the charter fee is retained.

Any refund due will be calculated based on amounts actually received by Blue Freedom Yachting, minus the applicable cancellation fee, bank fees, payment processing fees, and any non-refundable third-party costs already incurred.

23. Company Cancellation or Yacht Unavailability

Blue Freedom Yachting reserves the right to cancel, modify, or alter the charter due to yacht unavailability, operational issues, safety concerns, legal restrictions, port restrictions, technical problems, force majeure, or unforeseen circumstances.

Where possible, Blue Freedom Yachting may offer an alternative yacht of a similar price range.

If no suitable alternative is available, the customer will receive a refund of payments made for the charter.

Blue Freedom Yachting shall not be liable for any further compensation beyond the amounts paid by the customer.

24. No-Refund Situations

No refund will be provided where the charter is cancelled, interrupted, shortened, delayed, or terminated due to:

  • customer late arrival;
  • customer no-show;
  • customer early departure;
  • missing or invalid travel documents;
  • failure to pay on time;
  • breach of these Terms & Conditions;
  • refusal to follow captain instructions;
  • unsafe or abusive behavior;
  • intoxication or disorderly conduct;
  • illegal drugs, weapons, or unlawful activity;
  • exceeding the agreed guest limit;
  • damage caused by the customer or guests;
  • customer-requested itinerary changes;
  • weather or sea conditions;
  • port restrictions or authority decisions outside the company’s control.

25. Force Majeure

Blue Freedom Yachting is not liable for failure or delay in performing its obligations where such failure or delay is caused by events beyond its reasonable control.

Force majeure may include, but is not limited to, acts of God, storms, adverse weather, sea conditions, fire, explosion, collision, grounding, mechanical or electrical breakdown beyond the company’s reasonable control, war, civil unrest, strikes, port restrictions, government action, legal restrictions, epidemics, pandemics, natural disasters, or other events outside reasonable control.

In case of force majeure, Blue Freedom Yachting’s maximum liability is limited to the amount actually paid by the customer to Blue Freedom Yachting for the affected charter.

26. Complaints

Any complaint must first be reported to the captain during the charter so that the issue can be addressed immediately.

If the issue cannot be resolved on board, the customer must notify Blue Freedom Yachting as soon as possible and, where practicable, within 24 hours of the event.

Complaints must be confirmed in writing by email, with a clear description of the issue, date, time, and relevant details.

Failure to report a complaint during the charter may limit Blue Freedom Yachting’s ability to investigate or resolve the issue.

27. Non-Assignment

The customer may not transfer, assign, resell, sub-charter, or give control of the booking or yacht to another person without prior written approval from Blue Freedom Yachting.

28. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by the laws of Greece, unless mandatory consumer protection laws provide otherwise.

Any dispute shall be subject to the competent courts of Greece, unless otherwise required by applicable mandatory law.
